1.GST REGISTRATION:

GST is the biggest tax reform in India, tremendously improving ease of doing business and increasing the taxpayer base in India by bringing in millions of small businesses in India.

2.MSME REGISTRATION

MSME stands for micro, small and medium enterprises and any enterprise that falls under any of these three categories. MSME enterprises are the backbone of any economy and are an engine of economic growth, promoting equitable development for all. Therefore, to support and promote MSMEs, the Government of India through various subsidies, schemes and incentives promote MSMEs through the MSMED Act. To avail the benefits under the MSMED Act from Central or State Government and the Banking Sector, MSME Registration is required.


Following are the conditions which need to be fulfilled to qualify under MSME Act.

  • All the manufacturing enterprises which have invested less than 10 crores in machinery and plant are allowed to be registered as MSME.
  • In service enterprises, the investment in plant and machinery should not be more than 5 crores.
  • And in near future, if your enterprise exceeds the maximum limit, then it will not sum up as MSME.

3.PROFESSIONAL TAX

Profession Tax is a tax levied on a person engaged in any profession, trade, calling and employment in West Bengal. The West Bengal State Legislature enacted the “West Bengal State Tax on Professions, Trades, Callings and Employments Act, 1979” in exercise of the power conferred by the Article 276 of the Constitution of India (under Entry No. 60 of the “State List” relating to taxes on professions, trades, callings and employments). The Act came into effect on and from 1-4-1979.


Those who are liable to pay Profession Tax under the act may be divided into two categories:

  • ENROLLMENT : Persons engaged in professions, trades, callings and employments. A Person requires Certificate of Enrolment, annual payment of tax, but NOT filing of any Return.
  • REGISTRATION : Employer (Government, Public and Private Sectors who disburse salary/wages to the employees). An Employer requires Certificate of Registration, monthly payment of tax and filing of annual Return.

4.TRADE LICENSE

Trade license, also known as a business license, is a permit that is issued by the Government to an individual or a company to run a business. These licenses are used across the country and must be obtained from the respective State government for the performance of trade. 5.TRADE MARK

A trademark can be one word, a group of words, sign, symbol, logo, or a combination of any of these that you can use to distinguish your product from those of your competitors. a trademark can be protected through registration. Registration gives the trademark owner the exclusive right to use the mark and to prevent others from using the same or similar marks on identical or related goods and services.

Trademarks in India are registered by the Controller General of Patents Designs and Trademarks, Ministry of Commerce and Industry, Government of India. Trademarks are registered under the Trademark Act, 1999 and provide the trademark owner with a right to sue for damages when infringements of trademarks occur. Once a trademark is registered, R symbol can be used and the registration will be valid for 10 years. Registered trademarks nearing expiry can be easily renewed by filing a trademark renewal application for a period of another 10 years.

Formation of the NGO as Trust

A Group of Individuals can deliver goods to society by forming public charitable trusts. The concept of trust generally involves endowment of some property for public utility under certain norms. At present the practice of establishing family or public charitable Trusts by sparing certain cash amount for charitable, welfare or religious purposes is prevalent. Society should contain a minimum of 2 members.

According to the Society Registration Act, Society or association is an organised group of people objective united together by agreement to determine, deliberate and collaborate for the non-profitable services. Society has to be registered at the time of forming with an application at the appropriate Registrar of Firms. Society should contain a minimum of 7 members (general body) and a minimum of three executive committee members.
